التعليل بالحكمة عند الإمام مروان بن علي البوني (ت440هـ) من خلال كتابه "تفسير الموطأ"

Abstract

الملخص يعتبر موضوع التّعليل بالحكمة محلّ جدل بين العلماء، فهو يمثل الجانب المعقول من شريعتنا الغرّاء في مقابل المنقول منها، حيث اختلف فيه العلماء عموما إلى ثلاثة مذاهب، بين مانع ومجيز وقائل بالتّفصيل؛ فالمانعون من التعليل بالحكمة يدلّلون على مذهبهم بعدم انضباط الحكمة؛ مما يؤدي إلى اضطراب الأحكام، أمّا المجيزون لذلك فيعلّلون مذهبهم أنّ الشريعة موضوعة لمصالح العباد في الدّارين فهي في أصلها موضوعة لحكمة، فالمنع من التعليل بها بمثابة فصل الشّريعة عن روحها، وهذا المذهب هو الراجح لقوة أدلّته، أمّا من ذهب منهم إلى التفصيل فيرى التعليل به إذا كانت ظاهرة منضبطة بنفسها، وإلاّ فالمنع. ومن المدارس الفقهية الرائدة في باب التعليل بالحكمة المدرسة المالكية، ومنها الإمام مروان بن علي البوني المتوفى سنة 440ه، فقد أكثر من التعليل بالحكمة في كتابه تفسير الموطأ من خلال تخريجه للفروع الفقهية، وتعليله لآراء أئمة المذهب، ولقد تمّ التطرق في البحث إلى نماذج تطبيقية من كتابه تفسير الموطأ، حيث اختلف منهجه في ذلك وتنوعت طرائقه. الكلمات المفتاحية: مروان بن علي البوني، التعليل بالحكمة، تفسير الموطأ. Abstract: The topic of reasoning with wisdom is a subject of controversy among scholars, as it represents the reasonable side of our glue as opposed to what is transmitted from it, where scholars differed in general to three doctrines, between the objection, the permissible, and said in detail; Those who are prevented from justifying wisdom demonstrate their doctrine by the lack of discipline in wisdom.
