آليات الرقابة على المجالس البلدية المنتخبة وأثره على الحوكمة المحلية فـي الجزائر

Abstract

إن الرقابة لها دور في الإصلاح الإداري والتنمية المحلية، فهي إحدى الأسس التي تقوم عليها الدولة الديمقراطية، كما أن الإفراط والتشديد في ممارسة الرقابة يؤدي إلى تقييد أداء الإدارة الجيد والفعال في ظل بروز مفهوم الحوكمة الرشيدة التي تعمل على تقريب الإدارة من المواطن لتحقيق وخدمة مصالحه، لهذا فأعضاء المجالس البلدية المنتخبة تفرض عليهم قيود من خلال ما يسمى بالسلطة الوصائية بهدف ممارسة رقابة عليهم حماية لمبدأ المشروعية وضمان سلامة سائر الأعمال بتوافق مع الدستور والقوانين، حتى لا تصبح لهذه المجالس سلطة مطلقة. ووفقا لما سبق فهذه الدراسة تهدف إلى معرفة حدود الرقابة الممارسة على منتخبي المجلس البلدي ومامدى تأثيرها على تجسيد الحوكمة المحلية في الجزائر. Oversight has a role in administrative reform and local development, it is one of the foundations of the democratic state, and a tool to achieve effective and rational governance, and excessive and tight control leads to restrict the performance of good governance and effective in the emergence of the concept of good governance that works to bring the administration closer to the citizen to serve And achieve his interests, Therefore, elected members of municipal councils are subjected to restrictions through the so-called trusteeship authority to exercise control over them to protect the principle of legitimacy and ensure the safety of all works in accordance with the Constitution and laws. so that these councils do not have absolute authority, Therefore, this study aims to know the limits of the control exercised on the elected municipal people's assembly and its impact on local governance in Algeria.
