دور النيابة العامة كحامية للنظام العام في قانون الأسرة الجزائري (المادة 3 مكرر من قانون الأسرة الجزائري)

Abstract

يتناول هذا المقال المادة: 03 مكرر من قانون الأسرة الجزائري التي جاء بها تعديل 2005؛ والتي عمد من خلالها المشرع إلى إبراز مكانة الأسرة؛ وخطورة المصالح المتعلقة بها؛ باعتبارها جزء مهم من النظام العام كون الأسرة هي الخلية الأساسية في تكوين ركن الشعب للدولة. كما يتناول مناقشة مقصد المشرع من وراء المادة سابقة الذكر والجدل الفقهي الذي ثار حول تفسيرها؛ من خلال إبراز مختلف أقوال شراح قانون الأسرة الجزائري؛ والأدلة التي اعتمدوها في تأسيس أقوالهم بالإضافة إلى اقتراحاتهم في ما يخص تعديلها وإعادة صياغتها. This article deals with Article 3bis of the Algerian Family law, which introduced by the 2005 amendment; through which the legislator has demonstrated the status of the family and the seriousness of its interests as an important part of public order. This article discusses the purpose of the legislator behind the above-mentioned article and the jurisprudential argument that has arisen over its interpretation by highlighting the various statements of the Algerian family law dissertation; the evidence they have adopted in establishing their statements, as well as their suggestions regarding the amendment and redrafting of Article 3bis of the Algerian Family law.
