Abstract

تعد مرحلة الطفولة مرحلة حساسة في حياة الفرد يمكن أن يقوم الصغير بأفعال مخالفة للقانون تكيف ضمن نطاق الجنوح، ولكي يتم التعامل مع تلك الظاهرة ومواجهتها قام المشرع الجزائري بإقرار ضمانات قانونية لسيما أثناء حبس الطفل الجانح مؤقتا. إذ أن الحبس المؤقت إجراء من إجراءات التحقيق، يهدف الي تحقيق التوازن بين مصلحة المجتمع من جهة وبين مصلحة الفرد من جهة أخرى، إلا أنه في ذات الوقت يشكل إعتداء صارخا على قرينة البراءة والحرية الفردية.
