الحقوق والحريات العامة وحدود ممارستها فـي التشريع الجزائري

Abstract

تستمد سيادة القانون من سيادة الدستور، فهو الذي يضع الأسس التي يقوم عليها القانون بكل فروعه، وبهذه العلاقة العضوية بين الدستور والقانون تتدرج القواعد القانونية من حيث المرتبة فيتخذ منها الدستور وضعه الأسمى، وعليه تمثل الحقوق والحريات العامة في النظام القانوني الجزائري محورا أساسيا كرسته معظم نصوصه الدستورية، حيث ينص على الضمانات التي تكفل ممارسة هذه الحريات كما أنه يتضمن الحدود والضوابط اللازمة لممارستها، والتي يجب أن تحدد بطريقة مسبقة وتفصيلية من طرف السلطة التشريعية في الدولة. The rule of Law derives from the sovereignty of the Constitution. It establishes the foundations of the Law in all its branches, and with this organic relationship between the Constitution and the Law, the legal rules range from the level of ranking and the constitution makes the supreme position, the public rights and freedoms in the Algerian legal system are, as a basic axis, enshrined in most of its constitutional provisions, which provid the guarantees guaranteeing the exercise of these freedoms and it also contains the necessary limits and rules for its exercise, which must be determined in a prior and detailed manner by the legislative authority of the State.
