الديمقراطية التشاركية في الجزائر بين النصوص القانونية والواقع العملي

Abstract

إن تبني الدولة الجزائرية لفكرة الديمقراطية التشاركية، الهدف منه إشراك المواطن في تسيير شؤونه من جهة، ومن جهة أخرى تحقيق التنمية، ومن أجل تحقيق هذه الغاية فإن المشرع الجزائري أصدر مجموعة من النصوص القانونية، أهمها قانون الجماعات الإقليمية، والذي جاء لينظم عمل الهيئات المحلية (البلدية، الولاية) في إطار تكريس مبدأ الديمقراطية التشاركية. غير أن هذه الإصلاحات القانونية، وتطبيقا على أرض الواقع عرفت العديد من النقائص، والعراقيل التي ظهرت جليا من خلال بعد المواطن عن مؤسسات الدولة، وضعف التنمية على المستوى المحلي، والوطني. وتسعى هذه الدراسة إلى تبيان الفجوة الموجودة بين النصوص القانونية والواقع المعاش. The adoption of the Algerian state of the idea of participatory democracy aims at involving the citizen in the management of his affairs from one side, and to achieve the overall development on the other side. In order to achieve this objective, the Algerian legislator has issued a set of laws, among which the law of local authorities which aims to organize the work of local bodies (commune, wilaya) in the framework of the embodiment of the principle of participatory democracy. However, these law reforms when applied have experienced various shortcomings and obstacles characterized by the distance between the Citizen and his institutions, as well as the weak development at the local and national levels.
