Abstract

أوجبت أغلبية التشريعات عند تطبيق العقوبات البديلة ضرورة موافقة المحكوم عليه على العقوبة البديلة كآلية لترشيد السياسة العقابية كون إشراك المحكوم عليه في تنفيذها يساهم في تأهيله و إصلاحه وإعادة إدماجه في المجتمع حتى تحقق الهدف منها وبلوغ ما يسمى بالعدالة الرضائية التي تشمل كل مراحل الدعوى الجزائية وصولا إلى مرحلة التنفيذ العقابي باستحداث عقوبات بديلة عن العقوبة السالبة للحرية تنفذ بتعاون من المحكوم عليه The majority of legislation in the application of alternative penalties necessitated the consent of the convicted to the alternative punishment as a mechanism to rationalize the penal policy that the participation of the convicted in its implementation contributes to rehabilitation and reform and reintegration in society to achieve its objective and reach the so-called consensual justice, which includes all stages of criminal proceedings to The phase of punitive implementation by introducing alternative penalties for the deprivation of liberty shall be carried out with the cooperation of the convicted person.
