إدمـاج الأراضـي الفـلاحية الوقفية ضمن الأراضي العمرانية في التشريع الجزائري

Abstract

إن إرادة الواقف هي التي تحدد نوع الوقف والجهة الموقف عليها كما تحدد طريقة استثمار الوقف، وهذه الإرادة محمية من طرف الدولة وتسعى لتنفيذها، والأصل أن يستغل الوقف من طرف الجهة الموقوف عليها وفقا لطبيعته، دون أن يكون لأي شخص تغيير وجهته واستغلاله بطريقة أخرى، إلا أن المشرع في المادة 26 مكرر3 من القانون 01-07 المعدل والمتمم للقانون 91-11 والمتعلق بالأوقاف، أجاز إمكانية إدماج الأراضي الفلاحية الوقفية المجاورة للتجمعات السكنية ضمن الأراضي العمرانية طبقا لأحكام القانون 90-29 المتعلق بالتهيئة والتعمير.
