Abstract

يعد الحق في الضمان الاجتماعي حقا أساسيا من حقوق الإنسان له خصائص مميزة عن باقي الحقوق تجعله مهما، يهدف لحفظ كرامة الإنسان دون تمييز أو استثناء عن طريق تقديم خدمات اجتماعية وفق ما جاء في أرضية الحماية الاجتماعية، يقوم على مجموعة عناصر أساسية تضمن تطبيق ضمان اجتماعي جيد وفعال. يفرض هذا الحق على الدول الأطراف في العهد الدولي للحقوق الاقتصادية والاجتماعية والثقافية التزامات تضمن تجسيده فعليا في الواقع ولو تدريجيا.The right to social security is a basic human right that has distinct characteristics from the rest of the rights that make it important, aiming to preserve human dignity without discrimination or exception by providing social services according to what was stated in the ground of social protection, based on a set of basic elements that ensure the application of good social security And effective.
