خطــاب ضمـان المناقصـات الـدوليـة فـي ظـل المـرسـوم الرئاسـي 15-247

Abstract

تلعب الضمانات البنكية دورا في تسهيل إبرام وتنفيذ الصفقات العمومية الدولية، بما تمنحه للمقاولين ورجال الأعمال من ائتمان لدى الجهة المعلنة عن المناقصة لقبول التعامل معهم. وقد أشار المرسوم 15-247 إلى جملة من هذه الضمانات، لكنه لم يتناول بشكل صريح مصطلح "خطاب الضمان" والمتعارف عليه لدى الدول العربية.Bank guarantees play a role in facilitating the conclusion and execution of international public transactions, giving entrepreneurs and businessmen the credit of being accepted to deal with the project owner. Decree 15-247 refers to a number of these guarantees, but does not explicitly address the term "guarantee letter", which is customary in Arab countries.
