قاعدة "الضرورات تبيح المحظورات" وأثرها في عملية زرع أعضاء الخنزير في جسم الإنسان

Abstract

من معالم رفع الضيق والحرج في شريعتنا أنها أباحت للمضطر ما كان في أصله محرما، إذا بلغ حد الاضطرار ولم يجد ما يغنيه من الحلال، وقد أمرت بحفظ النفس البشرية من الهلاك ولو بمحرم عند الضرورة، وعليه فقد أجاز الكثير من علمائنا نقلَ وزرعَ أعضاء الحيوان ولو كان نجسا كالخنزير في جسم الإنسان إذا أُمن الضرر، ولا يؤثر ذلك في صحة الصلاة، لأنَّ مقام الاضطرار يختلف عن مقام الاختيار، مع التنبيه إلى ضرورة التنظيم المحكم لكيفية الاستفادة من الثروة الحيوانية تفاديا لانقراضها. One of the features of removing distress and embarrassment in Islam (Sharia) law is that it gives permission to the forced person to have (what was originally forbidden) if he reached the limits of necessity and did not find what suffices him from Halal (the lawful). Our Sharia commanded to protect the human soul from destruction، even with a forbidden thing(s)/action(s)when necessary، accordingly، many of our scholars (Imams) permitted the transfer and cultivation the organs of the animal، even if it is impure، like a pig in the human body، if it is harmless(not harmful) and this does not affect the validity of the prayer;because the situation of compulsion differs from the situation of choice، also، with tight organization of how to benefit from animals' wealth in order to avoid its extinction.
