اللجنة المصرفية ودورها في الرقابة على التعاملات المالية في ظل القانون المتعلق بالنقد والقرض03 - 11

Abstract

تعتبر مسألة الرقابة على مدى احترام البنوك والمؤسسات المالية للأحكام التشريعية والتنظيمية خاصة في مجال الرقابة على حركة رؤوس الأموال من أهم المسائل الجوهرية التي لها صلة مباشرة في الحفاظ على الاقتصاد الوطني من خلال ضمان التوازن المالي للبنوك وبالتالي الحفاظ لما لها من انعكاسات مباشرة على القيمة السوقية للدينار الجزائري مقارنة بالعملات ألأجنبية من أجل ذلك أقر المشرع الجزائري في القانون 03/11 المتعلق بالنقد والقرض إنشاء هيئة تسمى في صلب النص اللجنة المصرفية وأوكل لها مجموعة من المهام التي تضمن من خلالها فرض الرقابة على البنوك والمؤسسات المالية من أجل ضمان احترامها للأحكام التشريعية والتنظيمية المطبقة عليها وهو الأمر الذي سنحاول التطرق اليه في هذه المداخلة من خلال تسلط الضوء على اللجنة المصرفية من حيث الطبيعة القانونية والتشكيلة والسلطات الممنوحة لها بموجب القانون 03/11 المتعلق بالنقد والقرض .The issue of control over the respect of banks and financial institutions of legislative provisions and especially the field of capital controls and of the mort fundamental issues which are directly relevant in maintaining the national economy by ensuring financial balance of banks . thus main ting their direct impact on market value for Algerian dinar compared to foreign currencies that is why the Algerian legislator approved in low 03/11 relating to cash and loan create a body called in the body of the text . the banking committee has entrusted it group of tasks that ensure the control of banks and financial intuitions in order to ensure their respect of legislative provisions and regulatory requirements and that is what we will try to talk to him in this intervention through the high light in terms the bonking committee legal nature and composition and power granted her under the law 03/11 relating to cash and loan .
