المســــؤوليـــة المـــدنيــــة للــبنــــك

Abstract

إذا أخل البنك بالتزام فرضه عليه القانون أو العقد تترتب المسؤولية المدنية، وهو إخلال يمثل خطأ جزاؤه المدني التعويض وعليه يسأل البنك مدنيا عن الأعمال والخدمات المصرفية التي يؤديها، إما لمخالفته العقد المبرم بينه وبين العميل وإما لمخالفته للقانون، ومسؤولية البنك المدنية إما أن تكون عقدية أو تقصيرية. يتمثل الأساس النظري لمسؤولية البنك المدنية في الخطأ، أما الأساس القانوني فنرجع فيه إلى الأحكام العامة والنصوص التنظيمية لأن المشرع لم ينظم أحكام مسؤولية البنك وإنما بين نطاقها ومحدوديتها بمخالفة الالتزامات المنصوص عليها في القوانين، أي أن المسؤولية المدنية للبنك تترتب عند مخالفة القواعد القانونية.
