العقـوبـة المـاليـة على الجرائـم المـرورية فـي ضـوء قانـون المـرور الجـزائـري

Abstract

تمثل العقوبة المالية أو الغرامة الجزافية بُعداً مهمًا في السياسة الجنائية العقابية المتبعة لمكافحة الجريمة عموما وتلك المتعلقة بالجرائم المرورية بالخصوص، ومع انتشار ظاهرة الحوادث المرورية وما يسببها من مخالفات مرورية تميّزت بالطيش والتهور واللامبالاة وعدم احترام الأنظمة واللوائح، ستحاول هذه الورقة البحثية تسليط الضوء على السياسة الجزائية للمشرع الجزائري في مجال الغرامة المالية كعقوبة أصلية وضعها قانون المرور في إطار معالجة المخالفات المرورية ومكافحة الجريمة المرورية بنوعيها مخالفات كانت أو جنح، حيث تمّ تقسيم الدراسة إلى ثلاثة مطالب، يعالج الأول مفهوم الغرامة الجزافية ضمن قانون المرور الجزائري، أما المطلب الثاني فتناول الغرامة الجزافية المخصصة للجرائم المرورية المصنفة مخالفات في ضوء القانون رقم 01-14 المؤرخ في 19/8/2001 بتعديلاته وتتميماته، وأخيرا تناول المطلب الثالث الغرامة الجزافية المخصّصة للجرائم المرورية المصنّفة جُنحا ضمن الإطار نفسه. حيث خلصت الدراسة في الأخير إلى استيضاح بعض الثغرات التي استدركها المشرع الجزائري وأخرى تمّت التوصية بوجوب العمل على تداركها من أجل تمكين قانون المرور من معالجة فعالة لقضايا هذا النوع من الجرائم المرورية. The financial penalty or the fine is an important part of the punitive criminal policy used to combat crime in general and traffic offenses in particular, and with the spread of traffic accidents and traffic violations, characterized by recklessness, recklessness and lack of respect for regulations and regulations, The study sheds light on the criminal policy of the Algerian legislator in the area of financial fines as an original penalty which was established by the Traffic Law in the framework of dealing with traffic violations and combating traffic crimes, both of which were offenses or misdemeanors. The first is the concept of the fine within the Algerian Traffic Law, The second requirement deals with the fine imposed for traffic offenses classified as irregularities in light of Law No. 01-14 of 19/8/2001 with its amendments and amendments. Finally, the third request dealt with the fine imposed for traffic offenses classified as misdemeanors within the same framework. The study concluded by clarifying some of the gaps that the Algerian legislator has realized, and that he should work to correct them in order to enable the Traffic Law to effectively address the issues of this type of traffic crime.
