التأصيـــل الفقهــي للأمراض المعاصــرة وأثرها في الفرقة بين الزوجين دراسـة مقارنـة بقانـون الأسرة الجزائري

Abstract

انتشرت في وقتنا المعاصر أمراض كثيرة لم تكن معروفة لدى الفقهاء القدامى ، منها المعدية والمزمنة والوراثية، ... وكثيرا ما تسبب هذه الأمراض حرجا في العلاقة الزوجية.وإذا رجعنا إلى الكتب الفقهية نجد أنها تناولت ما له علاقة بهذا الموضوع في باب العيوب المثبتة للخيار في الزواج. وهذا البحث هو دراسة تأصيلية لهذه الأمراض من أجل بيان مدى توافقها مع ما ذكره الفقهاء في التفريق للعيب، ثم بيان موقف قانون الأسرة الجزائري تجاه هذه الأمراض، وأثرها في التفريق بين الزوجين. Summary Many diseases that were not known to the old jurists, including infectious, chronic and hereditary, have spread in our time. These diseases often cause embarrassment in the marital relationship. If we go back to the jurisprudential books we find that it dealt with what is related to this subject in the section of proven defects of choice in marriage. This research is a detailed study of these diseases in order to indicate the extent of compatibility with what the scholars in differentiating the defect, and then the position of the Algerian family law towards these diseases, and their impact on the differentiation between the spouses. key words : Rooting; defects and diseases; option; differentiation; Algerian family law.
