Abstract

تُعد الحماية الإدارية للثروات الغابية من أهم جوانب الحماية القانونية نظرا لأهميتها في الوقاية من التهديدات التي تواجه الغابات. هذه الحماية تتميز بطبيعتها الوقائية التي تهدف إلى المحافظة على الغابات ومنع تدهورها، من خلال تطبيق إجراءات وضوابط قانونية محددة. يشكل الضبط الإداري البيئي محورا رئيسيا في هذه الحماية، إذ يتضمن مجموعة من الآليات والإجراءات التي تهدف إلى تنظيم الأنشطة البشرية وتقليل الإضرار التي قد تلحق بالبيئة الغابية. ومن بين الآليات المستحدثة في إطار القانون 23-21 المتعلق بالغابات والثروات الغابية تبرز آلية "الوضع تحت الحماية" كإجراء عملي مهم في مجال حماية الثروة الغابية، حيث تهدف هذه الآلية إلى تعزيز الحماية الاستباقية للمناطق الغابية المتدهورة من خلال فرض قيود صارمة على الأنشطة الغابية وضغط الحيوانات التي قد تؤدي إلى زوال الثروة الغابية، كما تعزز هذه الآلية من قدرة الإدارة على تنظيم الأنشطة الغابية بما يضمن تعافي الغابات المتدهورة وبالتالي المحافظة عليها.
