الممارسة العملية للقضاء الدولي الجنائي وتطور مفهوم الجرائم ضد الإنسانية

Abstract

يتناول هذا ا البحث إبراز مساهمة القضاء الدولي من خلال تجربة المحاكم الجنائية الدولية بمختلف صورها، انطلاقا من معاقبة مرتكبي الجرائم الدولية، هاته الممارسة أسهمت في تطوير وتحديد تعريف دقيق لمفهوم الجرائم ضد الإنسانية، والتي تعدّ أحد صور الجرائم الدولية الحديثة والأشد خطورة، حيث أن الممارسة القضائية لهاته المحاكم، أسهمت في إيجاد تعريف شامل ودقيق للجرائم ضد الإنسانية، كتشريع دولي جنائي، تم إقراره من خلال نص المادة (7) من النظام الأساسي للمحكمة الجنائية الدولية، ومن ثمّ إرساء مبدأ المسؤولية الجنائية الدولية للأفراد، عن ارتكاب الجرائم ضد الإنسانية.This study deals with the contribution of the international judiciary through the experience of international criminal courts in various forms, from punishing international crimes. This practice contributed to the development and definition of the concept of crimes against humanity, which is one of the most modern and dangerous forms of international crimes. Which have been established through the provisions of article 7 of the Statute of the International Criminal Court and thus establish the principle of international criminal responsibility for individuals for the commission of crimes against humanity The vessels.
