الحوكمة المصـرفيـة ورهـان مكافحـة جـرائـم الفسـاد المـالي المبـادئ وآليـات التطبيـق فـي الجـزائـر

Abstract

تشكل كفاءة المؤسسات المصرفية أحد أبرز المؤشرات الجاذبة للاستثمارات الداخلية والأجنبية، بوصفها اللاعب الأساسي في بناء الاقتصاد ونموه خاصة بالنسبة لتلك الدول التي تعاني من انعدام الأسواق المالية أو نقص فعالية وكفاءة أسواقها المالية كالجزائر. ولأجل ترقية العمل المصرفي وحمايته من كل الاختراقات المنافية للقانون وأبرزها جرائم الفساد المالي، عملت الجزائر ومنذ 2009 على التأسيس للحوكمة الجيدة للمؤسسات ومنها المؤسسات المالية بتبني منظومة قانونية وإطار مؤسساتي رقابي لحماية العمليات المصرفية. وتأتي هذه الدراسة لتركز على الحوكمة المصرفية كأساس قوي لحماية الجهاز المصرفي من كل أشكال الفساد المالي، خاصة وأن الجزائر اليوم هي بحاجة أكثر من أي وقت مضى، مع تبنى سياسة الترشيد المالي بعد انهيار أسعار النفط وانخفاض احتياطات الصرف، بحاجة إلى الرفع من كفاءة وفعالية المصارف ومكافحة كل جرائم الفساد المالي التي تنخر في الاقتصاد الوطني. The efficiency of banking institutions constitute one of the most prominent indicators that attract domestic and foreign investment, as a key player in the construction of private economy and growth for those countries that suffer from a lack of financial markets or a lack of effectiveness and efficiency of the financial markets such as Algeria. In order to upgrade the banking business and protect it from all intrusions are contrary to the law, most notably the financial corruption crimes, Algeria and has worked since 2009 on the foundation of good governance institutions, including financial institutions to adopt the legal system and institutional regulatory framework for the protection of banking operations. The present study focuses on banking governance strong basis to protect the banking system from all forms of financial corruption, and Algeria need more, especially with the adoption of financial rationalization policy after the collapse of oil prices and the fall in the exchange reserves, to increase the efficiency and effectiveness of banks and combat all financial corruption crimes.
