Abstract

الملخص يعد عقد البوت من أهم الأساليب الاستثمارية التي تعمل على إنعاش الاقتصاد، ودفع عجلة التنمية الاقتصادية في المجتمع، وذلك من خلال إنشاء وإدارة مشاريع البنية التحتية، من دون أن يؤثر ذلك على الميزانية العامة للدولة. فعقود البوت إذا تعتبر فاعلا أساسيا في مجال إقامة وتسيير المشاريع الضخمة، لما تتميز به من خصائص عدة تجعل منها آلية مناسبة ووسيلة مثلى في تحقيق هذا الغرض الهام، لذلك فقد تم اعتماده في الآونة الأخيرة بشكل كبير سواء في الدول النامية أو الدول المتقدمة. ومن هذا المنطلق جاءت هذه المقالة لتعريف بعقد البوت، وما يتعلق به من خصائص ومجالات وأشكال، مع بيان أهميته كصورة أساسية من صور الشراكة بين القطاعين العام والخاص، هذا إلى جانب إبراز أهم المزايا المترتبة عن تطبيق هذا النوع من العقود. الكلمات المفتاحية: البوت، مشاريع، البنية التحتية، التنمية، مزايا. Summary The Bot Contract is one of the most important investment methods that revitalize the economy and advance economic development in society, through the establishment and management of infrastructure projects, without affecting the general budget of the state. The Bot Contracts, if they are considered an essential player in the field of establishing and managing large projects, because of its many characteristics that make it an appropriate mechanism and an ideal means for achieving this important purpose, therefore it has been adopted recently in a large extent, whether in developing or developed countries. From this standpoint, this article came to define the Bot Contract, and its related properties, areas and forms, with an indication of its importance as a basic form of partnership between the publicand private sectors, in addition to highlighting the most important advantages resulting from the application of this type of contract.
