Abstract

تعترف الدول الأطراف في العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية بالحق في العمل، الذي يشمل حق كل فرد في أن تتاح له إمكانية كسب رزقه بعمل يختاره أو يقبله بحرية، وتقوم باتخاذ التدابير المناسبة لصون هذا الحق. وعلى الرغم من الاقتراحات العديدة لممثلي بعض الدول إلا أن الأجهزة المسؤولة عن صياغة العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية، لم تبدي أهمية كافية لتبرير صياغة الحق في العمل في نص العهد، وتبنت أقل ما يمكن إيراده في هذا المجال، الأمر الذي دفع اللجنة المعنية بالحقوق الاقتصادية والاجتماعية والثقافية لتدارك ذلك فيما بعد، وذلك باعتماد تعليقات عامة على الحق في العمل الحقوق المرتبطة به تضمنت إرشادات ذات حجية. The States Parties to the present Covenant recognize the right to work, which includes the right of everyone to have the opportunity to earn a living by work freely chosen or accepted, and to take appropriate measures to safeguard this right. Despite numerous proposals by representatives of some countries, the bodies responsible for drafting the International Covenant on Economic, Social and Cultural Rights did not give sufficient importance to justify the formulation of the right to work in the text of the Covenant, and adopted the least that could be mentioned in this field.
