طبيعة وثائق مسح الأراضي في القانون الجزائري

Abstract

يقوم السّجل العقاري على كل من المسح العام للأراضي ومجموع البطاقات العقاريّة التّي ينشؤها المحافظ العقاري تكوينا لها، ويظهر في ذلك بعدين، البعد الشكلي في كل من وثائق مسح الأراضي والبطاقات العقارية، والبعد القانوني الموضوعي في قيد الحقوق وحفظها وتداولها. ويبدو أن لطبيعة وثائق المسح أثر هام في ذلك، لكن طبيعة هذا الأثر التّي يستمدها من طبيعة وثائق المسح في حد ذاتها، تتجاذبها مواقف المشرع، وما ينبغي أن تكون عليه حسب ما يراه الفقه القانوني.
