المركز القانوني للمستهلك أمام خدمات الوكيل العقاري في التشريع الجزائري

Abstract

يهدف هذا البحث إلى الكشف عن مهنة الوكيل العقاري وكذا عن علاقته بالمستهلك، اذ أصبح يأخذ دورا مهما في سوق العقار الجزائري خاصة بعد تنحي الدولة تدريجيا عن احتكار سوق الاسكان، ولعل هذا الانفتاح على السوق العقارية على ضوء المبدأ الدستوري المتضمن حرية الاستثمار والتجارة، زاد من أهمية تنظيم هذه مهنة خاصة في ظل التجاوزات التي يرتكبها ضدّ المستهلك وهذا ما حاول المشرع تكريسه من خلال خلق هذا التوازن بين المحترف والمستهلك ضمن المادة 43 من الدستور الجزائري، وقد أشارت الدراسة إلى الأشكال ممارسة هذه المهنة وكذا عن الآليات التي أقرها لحماية المستهلك العقاري .This research aims to reveal the estate agent profession as well as about his relationship with the consumer, as it became takes an important role in the Algerian real estate market, especially after the departure of the state gradually monopolize the housing market, and perhaps this openness to the real estate market in the light of the constitutional principle included freedom of investment and trade, increased the importance of organizing this profession especially in light of abuses committed against the consumer, and this is what tried legislator dedication by creating this balance between the professional and the consumer under Article 43 of the Algerian Constitution, the study indicated that shapes the practice of the profession, as well as on the mechanisms approved by the consumer Protection.
