الإطار الناظم للرقابة الدستورية دراسة مقارنة بين الجزائر وتونس

Abstract

لقد أوكل الدستور الجزائري للمجلس الدستوري مهمة الرقابة على دستورية القوانين مهما كان شكلها، حيث يعتبر هذا المجلس من مستحدثات دستور1989، الأمر الذي يجعله محل آمال الكثير في أن يكون حصنا منيعا لحماية الحقوق والحريات بالإضافة إلى تحقيق الاستقرار السياسي، والتعديل الدستوري لسنة 2016 قد أعاد ترتيب وتشييد المجلس الدستوري بمنحه فعالية أكثر سواء من خلال الاستقلالية التي قررها له أو من خلال توسيع تركيبته وصلاحياته، أما عن الدستور التونسي فقد أوكل مهمة الرقابة الدستورية إلى "المحكمة الدستورية" والتي استحدثها بموجب دستور سنة 2014، بعدما كان يصطلح عليها "المجلس الدستوري" قبل هذا الدستور. من خلال هذه الورقة البحثية سوف نحاول التطرق إلى جملة التعديلات التي مست أسمى هيئة مكلفة بالرقابة الدستورية وهي المجلس الدستوري الجزائري إضافة إلى المحكمة الدستورية التونسية، ونقوم بقراءة قانونية تحليلية لأهم النقاط الأساسية التي مسها الإصلاح في هذا الإطار. The Constitution of Algeria has entrusted the Constitutional Council with the task of supervising the constitutionality of laws regardless of its form. The Council is considered one of the innovations of the 1989 Constitution, which makes it the hope of many to be an impregnable fortress for the protection of rights and freedoms as well as political stability. And the establishment of the Constitutional Council by granting it greater effectiveness, whether through its independence or through the expansion of its structure and powers. As for the Tunisian Constitution, the constitutional oversight task was entrusted to the Constitutional Court, which was created under the 2014 constitution. Through this paper, we will attempt to address the various amendments that have been made by the highest constitutional oversight body, the Algerian Constitutional Council, in addition to the Tunisian Constitutional Court. We are conducting an analytical legal reading of the main points of the reform in this regard.
