تكييف العقوبة السالبة للحرية مع إعادة الإدماج الإجتماعي للمحبوس في الجزائر

Abstract

تطور مفهوم العقوبة وأغراضها، وتغيرت معه النظرة إلى مفهوم سلب الحرية وكذا حدوده ووسائله، فلم تعد العقوبة هدفا في حد ذاتها وإنما وسيلة لتحقيق أهداف أخرى تتمثل أساسا في إصلاح المجرم والقضاء على عوامل الخطورة الإجرامية لديه، وبالتالي العمل على تأهيله وإعادة إدماجه اجتماعيا ليصبح فردا منتجا وإيجابيا في المجتمع، وللوصول إلى هذه الغاية أوجب إعادة النظر في أساليب المعاملة العقابية المتبعة لتحقيق الأهداف المرجوة على أكمل وجه، فسارع المشرع إلى تكييف العقوبة السالبة للحرية خاصة في مرحلة تنفيذها، ومكن المحكوم عليه من الحصول على مكافئات وامتيازات تسمح له باسترجاع حريته الجزئية بعد تجاوبه مع برامج التأهيل وبتوفر شروط نص عليها القانون 05-04 المتضمن قانون تنظيم السجون وإعادة الإدماج الاجتماعي للمحبوسين.The concept of punishment and its purposes has evolved in addition; the perception of the concept of deprivation of liberty and its limits has changed as well. The punishment has not be came anaim in itself but rather a means to achieve other goals, mainly to reform the criminal and eliminate the criminal risk factors may have. Thus the concept works to restore rehabilitation and social integration to become a productive individual and positive within the community. To reach this goal it must have to review the methods of punitive treatment used to achieve the desired goals. Because of that, the legislature hastened to review the punishment, especially in the implementation phase, and allowed the sentenced prisoner to receive rewards and privileges that allowed him to regain his partial freedom.this can take place responded to the rehabilitation programs and have of the conditions stipulated in law 05-04, including the law of the organization of prisons and the social reintegration of prisoners.
