مشروعية المحادثة المرئية عن بعد وضمانات تطبيقها في مرحلة الاستجواب

Abstract

اتجه المشرع الجزائري في سياسته الجنائية الحديثة إلى تبني آليات قانونية أكثر عصرنة وحداثة، قادرة على مجابهة التطور التكنولوجي الحاصل بالشكل الذي يضمن سرعة الإجراءات والفصل في القضايا في أجال معقولة، من خلال تفعيل تقنية المحادثة المرئية عن بعد بموجب القانون 15/03، الا انه قد ربط إستخدامها بجملة من الضمانات التي من شأنها اضفاء المشروعية على هذا الاجراء خاصة عندما يتعلق الامر باستجواب المتهم. وعليه فان الهدف من هذه الدراسة: التعريف بهذه التقنية الاجرائية المستحدثة في التشريع الجزائري والوقوف عند ضمانات أعمالها للوصول إلى نتيجة مفادها ان مشروعية هذه التقنية رهين بمدى جودة الوسائل التقنية المستخدمة باعتماد المنهجين: التحليلي والوصفيIn its modern criminal policy,the Algerian legislator has adopted more modern legal mechanisms capable of confronting technological development to ensure the promptness of proceedings and the adjudication of cases within reasonbale deadlines by activating video conference under Law 03/15.however, the legislator has linked the use of this technology to the range of guarantees that would ligitimize it, especially regarding the interrogation of the accused. This study aims to introduce this new procedural technique in Algerian legislation and to stand at the guarantees of its work using analytical and descriptive research methods. the results indicated that the legitimacy of this technique depends on the quality of the used technical means.
