الآليات القانونية لمكافحة الأخبار الكاذبة في ظل أزمة كورونا

Abstract

تهدف هاته الدراسة إلى تحديد مدى فعالية الإجراءات التي اتخذتها الدولة الجزائرية في سبيل مكافحة الانتشار الرهيب للأخبار الكاذبة في جميع المجالات أثناء أزمة كورونا، بهدف الحفاظ على الأمن المجتمعي والنظام العام، حيث تناولت تحديد نطاق مفهوم الأخبار الكاذبة وخصائصها أثناء الأزمة، وبالاعتماد على المنهج الاثنوغرافي، تم تقديم رصد لأهم الشائعات التي تم الترويج لها في هاته الفترة والتداعيات الخطيرة التي أحدثتها. ومن خلال استقراء وتحليل مختلف الإجراءات والتدابير التي تم تنفيذها على مستوى الضبط الإداري والتشريعي، وتجليات ذلك على واقع الأزمة وظروفها، خلصت الدراسة إلى أن الاستراتيجية المتبعة من قبل الدولة، لم تستطع القضاء على ظاهرة انتشار الأخبار الكاذبة بشكل نهائي، وإنما ساهمت في حصرها والتخفيف من حجم التأثيرات السلبية الناتجة عنها. This study aims to determine the effectiveness of the measures taken by the Algerian state in order to fight the terrible spread of the fake news in all areas during the Corona crisis, with the aim of preserving societal security and public order, as it dealt with defining the scope of the concept of the fake news and its characteristics during the crisis, using the ethnographic method to determie the most important rumors that sppread in this period, and the dangerous repercussions it produced. Through an extrapolation and analysis of the various procedures and measures that have been implemented at the level of administrative and legislative seizure, and their manifestations on the reality of the crisis and its circumstances, the study concluded that the strategy adopted by the state was not able to permanently eliminate the phenomenon of the spread of the fake news, but rather contributed to restricting it and reducing the size of the negative effects resulting from it
