المتطلبات التنظيمية والضوابط الشرعية لصناديق الاستثمار العقاري الإسلامية: دراسة حالة صندوق كسب فرص العقاري

Abstract

هدفت الدراسة إلى تسليط الضوء على صناديق الاستثمار العقاري المتوافقة مع مبادئ الشريعة الإسلامية والتعرف على المتطلبات البشرية والإدارية اللازمة لإنشائها والضوابط الشرعية لمعاملاتها وتعاملاتها. وتنبع أهمية الدراسة من النمو الملحوظ لعدد هذه الصناديق في مختلف دول العالم ونمو حجم معاملاتها وزيادة الطلب عليها وتأثيرها في اقتصاديات الدول التي قامت بتبنيها. حيث خلصت الدراسة إلى مجموعة من النتائج تمثلت في أن إنشاء صناديق الاستثمار العقاري الإسلامية أمر بات ضروري بسبب ما تعرفه الساحة المالية من تطورات وذلك يجعل توفير كفاءات بشرية مكونة في هذا المجال أمر ضروري بالإضافة إلى ضرورة سن قوانين و لوائح تنظم إدارة هذه الصناديق، أيضا ضرورة تكييف معاملات أطراف المصلحة فيها بقواعد الشريعة الإسلامية لضمان حماية المستثمرين وكذلك إضفاء الصبغة الشرعية على أنشطة هذه الصناديق من تداول و تحمل الأرباح و الخسائر و الزكاة تحت رقابة لجنة تسهر على شرعية المعاملات و التعاملات.

The study aimed to shed light on real estate investment trusts that are compatible with the principles of Islamic Sharia, and to identify the human and administrative requirements for their formation and Islamic Sharia controls for their activities and dealings.The importance of the study stems from the increase of these REITs in various countries of the world, the growth in the volume of their transactions, the increase in demand for them, and their impact on the economies of the countries that adopted them.The study concluded that the formation of Islamic real estate investment trusts has become necessary due to the development of financial markets. Therefore, human competencies must be provided in this field, in addition to the need to formulate laws that regulate the management of these REITs, and also the need to make the transactions of investors and the REITs manager in accordance with the rules of Islamic Sharia to ensure their protection. As well as placing the activities of these REITs, including trading and bearing profits and losses and zakat, under the supervision of a committee that ensures that they are compatible with Islamic Sharia.
