Item الضمـانـات القانـونيـة لحمايـة الأسـرة - قـراءة فـي بعض التجـارب الدستـوريـة-(جامعة باتنة 1 الحاج لخضر, 2019-01-30) عمـاري, بـراهيـم; عبيشات, أمينةتعد الأسرة نواة المجتمع وحجره الأساس وركيزته الأساسية، وأحد الأنظمة الاجتماعية الأكثر ثباتا على مدى التاريخ، وأعظم المؤسسات الاجتماعية تأثيرا في حياة الأفراد، حيث تستمد عظمتها من الخصائص التي تتميز بها عن بقية النظم الاجتماعية الأخرى والوظائف التي تقوم بها، والتي تلعب دورا فعالا في بناء المجتمع والحفاظ على هويته، لذا وصفت الأسرة بالمرآة التي تعكس حضارة الشعوب، لذا اهتم التشريع الإسلامي ببناء ها ووضع الأحكام التي تنظمها. كما اهتمت التشريعات الوضعية على اختلاف مرجعياتها بهذه الظاهرة الاجتماعية العالمية، من خلال سن القوانين التي من شأنها توفير الحماية القانونية له، حتى يتمكن من تأدية المهام المنوطة به، وتحقيق مضمون رسالته السامية في الحفاظ على المجمع وتنميته من كافة النواحي، بدءا بالدساتير الوطنية المتضمنة للمبادئ الأساسية التي تحكم شكل الدولة والمجتمع وانتهاء بتشريعات الأسرة، بهدف توفير الحماية القانونية لكل الأشخاص الطبيعية والمعنوية على حد سواء، بما في ذلك الأسرة التي تحمل كثيرا من سمات الشخصية المعنوية المعروفة في القواعد العامة للقانون.
