    رقابة المحكمة الدستورية على السلطة الوطنية المستقلة للانتخابات

    تعتبر الانتخابات الوسيلة الأنجع لتجسيد حق الشعب لاختيار ممثليه في المجالس المنتخبة والمؤسسات الدستورية التي يمارس سيادته بواسطتها والمكرس في الدستور، ونظرا لأهميتها أوكل المشرع للسلطة الوطنية المستقلة للانتخابات كمؤسسة مستقلة مهمة الإشراف على مختلف مراحل العملية الانتخابية، وإدارتها بشكل حصري. أما بهدف ضمان ممارسة هذه الأخيرة لمهامها في شفافية وحياد وعدم تحيز، تختص المحكمة الدستورية بممارسة الرقابة على عمل السلطة المستقلة للانتخابات من خلال تصديها للطعون في القرارات الصادرة عن هذه السلطة، حيث أنها تتولى حل المنازعات المتعلقة بالنتائج المؤقتة للانتخابات الرئاسية والتشريعية، ونتائج الاستفتاء، كما أنها تبث في الطعون الخاصة بقرارات رفض الترشح للانتخابات الرئاسية، بالإضافة إلى الفصل في الطعون ضد قرارات لجنة مراقبة تمويل الحملة الانتخابية. Elections are the most effective means of reflecting the people's right to choose their representatives in the elected councils and constitutional institutions through which they exercise their sovereignty, enshrined in the Constitution, and given their importance, the legislator entrusted the Independent National Electoral Authority as an independent institution with the task of overseeing and exclusively administering the various electoral processes. With a view to ensuring the exercise of the latter's functions in transparency, impartiality and impartiality the Constitutional Court is competent to exercise control over the functioning of the Independent Electoral Authority by addressing appeals against the Authority's decisions; It is responsible for resolving disputes concerning the provisional results of the presidential and legislative elections , and the results of the referendum, as well as appeals against refusal to stand for election to the presidential elections in addition to adjudicating appeals against the decisions of the Campaign Finance Monitoring Committee.
