    الضمانات المستحدثة لإحلال التوزان العقدي بين أطراف العلاقة الاستهلاكية الإلكترونية

    تهدف هذه الدراسة إلى تبيان أهم الضمانات المستحدثة في التشريعات الوطنية، والتي تعمل على حثّ المستهلك الإلكتروني للوصول إلى تعاقد آمن، فتعزيز ثقة هذا الأخير بمجموع ضمانات خلال المرحلة السابقة واللاحقة للتعاقد كفيل لإعادة التوازن للعقد، لنخلص أن الضمانات المستحدثة لا تكفي لحماية المستهلك الإلكتروني خلال تعاقده؛ وهذا لعدم وجود تنظيم محكم لها، فالحماية الفعالة لهذا الأخير مرهون بإصدار قواعد قانونية محكمة يستند عليها خلال تعاملاته اليومية.The objective of this study is to highlight the most important guarantees provided in national legislation that encourage the electronic consumer to engage in secure contracting. Strengthening the consumer's trust through a comprehensive set of guarantees before and after the contract is crucial to restoring balance to the agreement. In conclusion, the newly established guarantees alone are insufficient to protect the electronic consumer during their contracting process due to the lack of a well-regulated framework. Effective protection for the consumer relies on the establishment of well-defined legal rules that form the basis for their daily transactions.
