    سرية التحقيق القضائي: الضمانات والانعكاسات قراءة في نص المادة 441 مكرر من قانون الإجراءات الجزائية الجزائري

    تعد سرية التحقيق الابتدائي من الخصائص المهمة التي يتمتع بها التحقيق الابتدائي في التشريعات المعاصرة نظرا لما تقدمه من مزايا عديدة، فهي تحظى بأهمية مزدوجة تتمثل في تحقيق فائدة كبيرة لمصلحة العامة من خلال الوصول إلى الحقيقة التي تنشدها العدالة الجزائية، كما أنها تبقى عقبة في وجه المجرمين الذين يريدون الفرار من وجه العدالة نتيجة لمعرفتهم بأخبار التحقيق، ومن جانب آخر تحمي الفرد البريء الذي لم تثبت إدانته بعد من التشهير به ومن الاعتداء على حريته، لذلك وضع المشرع الجنائي عقوبة رادعة كجزاء على مخالفة مبدأ سرية التحقيق الابتدائي حماية منه وصونا لحقوق وضمانات المتهمThe confidentiality of preliminary investigation is considered one of its mostimportant characteristics in contemporary legislations considering manyfeatures it offers; as it has double importance represented in its great benefitfor the public good, through reaching the truth that retributive justice seeks. Moreover, it remains an obstacle facing criminals willing to run off from facingjustice as a result to their knowledge of investigation news. From another side,the confidentiality of preliminary investigation protects the innocent individualthat has not been convicted yet from defamation and any abuse of hisfreedom. Thus, the retributive legislator has set a deterrent punishment facingany violation of the principle of preliminary investigation confidentiality, as aprotection and preservation of the rights and safeguards of the convict.
