Résumé:
The impediments to the implementation of penalties are the issues that arise after the penalty has been determined and call for its dropping from the person against whom it is required. We were able to limit the impediments to eight by extrapolating from the sources of Islamic criminal law, and we were able to categorize them into three groups by looking at the owner of the right to them. Obstacles caused by the victim, such as the victim's forgiveness, reconciliation, and inheritance of the right to punishment, and others caused by the offender, such as the offender's repentance, his death, the loss of the location of the punishment, and obstacles outside the parties to the conflict represented by the statute of limitations, as well as the offender's repentance of the offender. Loss of its location, nor repentance of the perpetrators.
