رد الدعاوي الإدارية شكلاً في قضاء محكمة العدل العليا الأردنية (دراسة مقارنة)

Abstract

تبحث هذه الدراسة موضوع رد الدعاوى الادارية في الاردن مقارنة مع فرنسا من زاويتين هما الطعن والطاعن. توصلت الدراسة إلى انه بينما اصبح الطعن في فرنسا مفتوحا أكثر فأكثر فإننا في الاردن نهجنا منهجاً تحفظياً أكثر فأكثر. توصي الدراسة بفتح وتيسير عملية الطعن.The study addresses the subject of non-acceptance of administrative law suits in Jordan in comparison to France from two main angles; the law suit and the plaintiff. It concluded that while, the situation in France got more and more open , in Jordan it grew more and more conservative. Finally the study proposes to open and facilitate the process of addressing administrative courts.
