من مواضيع الملكية الفكرية الأكثر إثارة للجدل، نجد موضوع برامج الحاسب الآلي الذي يكتسي أهمية بالغة في ميادين عدة بداخل الدول، وبالأخص اقتصادها الوطني على اعتبار أن هذا الموضوع يمثل أحد أحدث أوجه اقتصادات المعرفة، وبالرغم من حداثة استقلالية وتنظيم هذا الموضوع، إلا أنه أسال الكثير من الحبر في الوسطين الفقهي والتشريعي، إلى الحد الذي جعل المنظمة العالمية للملكية الفكرية الويبو تستنفر خبراءها المختصين لدراسة وبحث كافة الجوانب المتعلقة بهذا الموضوع .
وإذا كان كل من التشريع الدولي والوطني قد استقرا على توجه واحد وصريح، مفاده حماية موضوع برامج الحاسب الآلي بواسطة نظام حقوق المؤلف، إلا أن الجدل بقي مثاراً لدى الفقه حول مسألة الطبيعة القانونية لهذه البرامج، أين نجد فريقاً مؤيداً لهذا التوجه التشريعي الصريح، وفريقاً آخر يؤيد فكرة إعمال أنظمة حماية أخرى، إذ يأتي في مقدمتها فكرة حماية برامج الحاسب الآلي بواسطة نظام براءة الاختراع .
هذا الجدل المثار حول موضوع برامج الحاسب الآلي، أدى بنا إلى التفكير في البحث حول الخصوصية التي من الممكن أنها تحيط بهذا الموضوع، حتى جعلته بهذه الأهمية البالغة، وجعلته يحظى باهتمام أكبر بالمقارنة بباقي مواضيع الملكية الفكرية التي لاتقل أهمية عنه في كافة الحالات .
ولدراسة هذا الموضوع، ارتأينا إلى البحث حول ظروف نشأته وكذا التطورات التي طرأت عليه من الناحتين التقنية والقانونية، ومن ثمة تطرقنا إلى بيان محتوى هذا الموضوع وأوجه علاقته بفكرة الملكية الفكرية، وغايتنا في ذلك هي التوصل إلى بيان الخصوصية التي تميز موضوع برامج الحاسب الآلي عن باقي مواضيع الملكية الفكرية باعتباره أحد أحدث مواضيعها .
The subject of Computer programs is one of the the most controversial topics of Intellectual Property, this topic has great importance in several fields inside many deffrent states, and especially the economic field, where this subject is one of the most prominent face of the Knowledge Economy. And alltough the modernity of the independence and planning of this topic, but he ask a lot of ink between Jurisprudence and Legislation, to the extent that WIPO mobilize its experts to study and research all the aspects related to this topic .
Alltougth the stability of the deffrent legislation on one direction, that protect Computer programs by Copyright system, but the controversy remained standing on the legal nature of these programs, between who supported the legislative direction, and a supporter of adoption of other protection systems, and especially supporters of the idea of protecting computer programs by the patent system
This controversy on Computer programs, made us think about to research on this topic privacy, that him have this interest, compared with the rest of the topics of intellectual property. And to study this topic, we discussed about the circumstances of his birth, and stages of his development, then we clarify his content, and finally, his relationship with the idea of intellectual property.
