Résumé:
بمناسبة تطبيق تشريع وتنظيم الضمان الاجتماعي، تنشأ بين هيئات الضمان الاجتماعي من جهة، ومقدمي العلاج والخدمات المتعلقة بالنشاط المهني للأطباء والصيادلة وجراحي الأسنان والمساعدين الطبيين من جهة ثانية، منازعات تثور بشأن تقصير وارتكاب هؤلاء الأطباء والخبراء المتدخلين في إطار النشاط الطبي المتعلق بفحص المؤمنين اجتماعيا أخطاء أو تجاوزات للمهمة المسندة إليهم، ما من شأنه أن يحيد بواقع المرض أو الإصابة المحتج بها من طرف المؤمن اجتماعيا، ما يرتب خسائر مالية في ذمة هيئات الضمان الاجتماعي بدون وجه حق، ما يستوجب أحقية الطرف المتضرر بمطالبة حقه في التعويض والمتابعة القضائية، عليه أقر المشرع الجزائري في إطار التسوية الداخلية لمنازعات الضمان الاجتماعي قبل التوجه للجهات القضائية، لجنة أسند لها مهمة النظر ابتدائيا ونهائيا في كل الخلافات الناتجة عن ممارسة النشاطات الطبية التي لها علاقة بالضمان الاجتماعي وتترتب عنها نفقات إضافية لهيئة الضمان الاجتماعي، يطلق عليها تسمية اللجنة التقنية ذات الطابع الطبيOn the occasion of the implementation of the legislation and regulation of social security, arise between the social security bodies on the one hand and treatments provides and services related to the professional activity of doctors, pharmacists dental surgeons and medical assistant arising on the other hand dispute arise regarding the failure and the commission of the these doctors and experts intervening in the medical framework related to examining socially insured mistakes or abuses of the task assigned to them, which would entail financial losses in the handsof social security organization without right of that necessitates the right of injured party to claim it’s rights to compensation.Ajudicial acknowledged the Algerian legislature as part of internal settlement of dispute social security before heading to the judicial authorities of the committees assigned the task of considering primary and final all the differences resulting from the exercises of medical activities related to social security and arrange the expenses of the commission of social security called the naming committee technical of medical.
