Résumé:
أدت خطورة جرائم الفساد في ظل التطور العلمي والتكنولوجي في مختلف المجالات إلى عدم كفاية الأساليب التقليدية للبحث والتحري في الكشف عن الجرائم والحد منها.
وهذا ما دفع بالمشرع الجزائري إلى وضع الاستراتيجيات المناسبة، من خلال الاعتماد على الأساليب الحديثة للتحري من أجل مكافحة الجرائم بصفة عامة وجرائم الفساد بصفة خاصة، وتتسم هذه الأساليب بالمشروعية إذ أحاطها بجملة من الضوابط القانونية لضمان المساس بحرمة الحياة الخاصة، وتكمن هذه الأساليب في الترصد الالكتروني والاختراق والتسليم المراقب.
وعليه تتضمن هذه الورقة البحثية أحكام الترصد الالكتروني للبحث والتحري عن جرائم الفساد، وكذا القواعد المتعلقة بالتسرب والتسليم المراقب
The seriousness of crimes of corruption under the scientific and technological development in various fields has led to the inadequacy of traditional methods of research and investigation in the detection and limitation of crimes.
This, prompted the Algerian legislator to develop the appropriate strategies by relying on modern methods of investigation in order to fight crimes in general and corruption crimes in particular. These methods are legitimate, surrounded by a number of legal controls to ensure inviolability of private life. These methods include electronic surveillance, infiltration, and controlled delivery.
Thus, this paper includes the provisions of electronic surveillance for research and corruption crimes investigations, as well as the rules of infiltration and controlled delivery
