Résumé:
حرصت المملكة المغربية على تطوير سياستها في مجال محاربة الفساد، وإختارت خلال العقد الأخير، إنتهاج سياسات تشريعية في هذا السياق، حيث تم دسترة عدة أجهزة تهدف إلى تخليق الإدارة ومنع تفشي ظاهرة الفساد الإداري والمالي، وفي مقدمتها نجد الهيئة الوطنية للنزاهة والوقاية من الرشوة ومحاربتها، التي تعد كجهاز يتمتع بالشخصية المعنوية، وله نظامه القانوني الخاص به، يحدد دوره، تشكيلته وعمله.
وإنطلاقا من المكانة الهامة والمتميزة لهذه الهيئة، والتي بموجبها أحدث المؤسس الدستوري المغربي نقلة نوعية، وذلك بالإنتقال من هيئة مركزية إلى هيئة وطنية، ومحاولته مواكبة الجهود المبذولة من طرف المجتمع الدولي في مجال مواجهة هذا الداء الذي فتك بالأجهزة الإدارية، تتجلى إشكالية هذه الدراسة في معرفة الأسس القانونية للهيئة الوطنية للنزاهة والوقاية من الرشوة ومحاربتها، تحديد مفهومها، طبيعتها، بيان دورها، وذلك من خلال تقسيم موضوع الدراسة إلى محورين كالآتي:
المحور الأول: مفهوم الهيئة الوطنية للنزاهة والوقاية من الرشوة ومحاربتها في التشريع المغربي
المحور الثاني: الطبيعة القانونية للهيئة الوطنية للنزاهة والوقاية من الرشوة ومحاربتها ودورها في الحد من ظاهرة الفساد في المغرب
وتوصلنا إلى أن هذه الهيئة، مؤسسة دستورية، تتناقض تسميتها مع دورها، نظرا للخطأ في ترجمة إسمها للغة العربية، كما أن دورها يتداخل مع دور القضاء، وذات طبيعة متأرجحة بين المستقلة وغير المستقلة
Over the past decade, the Kingdom of Morocco has been keen to develop its anti- corruption policy, by choosing a legislative policy in this regard. Several institutions have been set up in the Kingdom's constitution to prevent administrative and financial corruption; the National Instance of Probity, Prevention and the Fight against Corruption, is at the forefront, and considered as an
institution endowed with the moral personality, its own legal system, it determines its role, its composition and his field of work. From the exceptional status of this institution, under which the Moroccan constitutional founder made a remarkable transition from a central instiution to a national one, while trying to follow the efforts of the international community to deal with this phenomenon dangerous. we have demonstrated its concept and role, into two axes, and we concluded that it was a constitutional institution whose name contradicts its role due to the error in translating its name from french into Arabic, and its role interferes with the role of the judiciary, and its nature is oscillating between an independent institution and non- independent.
