تفعيل الضمانات الدستورية لحقوق الإنسان في قوانين مكافحة الإرهاب بالجزائر

Abstract

حقوق الإنسان كقيمة عالمية تشمل الموجبات التي يحق لجميع الأشخاص التمتع بها بدون أدنى تمييز و ذلك لمجرد كونهم بشر، أي الحقوق و الحريات التي لا يمكن إنكارها أو تقييدها على أساس الثقافة أو التقاليد أو الجنسية أو التوجه السياسي أو المكانة الاجتماعية أو أية عوامل أخرى، و هي التي يجب ضمان حمايتها في الواقع و اعمالها بموجب القانون، و بشكل عام تشمل هذه الحقوق اهم الشروط الأساسية لوجود إنساني كريم، و يتم التأكيد عليها في المقام الأول ضد السلطات العامة أي وجوب احترامها و ضمانها و حمايتها و تنفيذها من قبل الحكومة و لكن في بعض الحالات تكون السلطة قادرة أيضا على تأكيدها ضد الأفراد الآخرين بصفتهم الخاصة، و منه أصبحت القوة المعيارية لحقوق الإنسان هي الدافع المانح لشرعية لسلوك الدولة الذي لا غنى عنه في ممارسة السلطة كمعيار للسيادة. و اذ يشير مصطلح "الإرهاب" في أعم مستوياته إلى الاستخدام الإجرامي للعنف ذي الخلفية أو الدوافع السياسية، و يستخدم المصطلح عادة للإشارة إلى شكل أو أسلوب خاص من ممارسة العنف السياسي القسري المولد للرعب بالارتباط مع مجموعة ممارسات تآمرية لعمل عنيف محسوب و مخطط و مباشر دون أدنى قيود قانونية أو أخلاقية، و يستهدف الإرهاب بشكل أساسي المدنيين و الأفراد من غير المقاتلين لما له من آثار دعائية و نفسية على مختلف الشرائح الاجتماعية ورأطراف النزاع، و هو منتوج الصراع على السلطة، و مع ذلك لا يوجد له تعريف فقهي أو قانوني موحد أو مفهوم متفق عليه على المستوى الدولي، فكثيرا ما يستخدم المصطلح لوصف نطاق واسع من الأفعال المرتكبة استجابة لظروف و ظواهر متفاوتة على المستويين المحلي و الدولي و غالبا ما يكون استخدامه مشحون و موظف سياسيا من قبل السلطة و منافسيها. Human rights have universal values with deep roots in all human civilizations and societies. People are entitled to enjoy them without discrimination, so the values such peace, freedom, social progress, equal rights, respect and human dignity are worth for all people simply because they are human beings, just as it is inconceivable to deny or limit them in any way, by means of culture, or because of traditions, or ethnic, religious affiliation, or because of nationality, political orientation, social status, or any other discriminatory factors, which must ensure their real protection by law. In general, these rights include the simplest conditions for a dignified human existence, and are affirmed primarily against public authorities, that’s why they must be respected, guaranteed and protected. The government has the responsibility to implement them in the state legislation, but the authority is also able to assert them against Other individuals, and from which the normative force of human rights has become the motivator that legitimizes state behavior that is indispensable in the exercise of power as a criterion of sovereignty. Whereas the term “terrorism” at its most general level refers to the criminal use of violence with a political background or motive, and the term is usually used to refer to a special form or method of practicing coercive and horror-generating political violence in association with a group of conspiratorial practices of calculated, planned and direct violent act without the slightest legal restrictions or Ethical, terrorism mainly targets civilians and non-combatants because of its propaganda and psychological effects on various social strata and parties to the conflict, and it is a product of the struggle for power. However, there is no unified legal or legal definition or an internationally agreed concept. The term is used to describe a wide range of acts committed in response to varying circumstances and phenomena at the local and international levels, and its use is often politically charged by the authority and its competitors.
