حماية حقوق الإنسان في ظل قواعد القانون الدولي الجنائي

Abstract

This study deals with the protection of human rights in light of the rules of international criminal law, This law, which is relatively recent at the international level, since its features have not been determined and its pillars and characteristics were not clarified Only after World War II, the Nuremberg trials had a great impact on the establishment and perpetuation of many international criminal rules to prosecute perpetrators of serious violations of human rights and fundamental freedoms, where it was the starting point for jurists and politicians to call for legal rules of an international nature to protect human rights. The United Nations proceeded, through its institutions, to codify the principles emanating from the Nuremberg court to be the first block in establishing international criminal law, which is the best mechanism for achieving international criminal protection in it’s both aspects objective and procedural, then international efforts continued within the framework of the United Nations and especially the International Law Commission, and it culminated in the conclusion of the Rome Convention, under which the permanent International Criminal Court was established to achieve the desired protection it was entrusted with the authority to exercise its jurisdiction over the most serious crimes of concern to the international community, as the crime of genocide, crimes against humanity, war crimes and crime of aggression. Despite the hopes associated with the establishment of this court, whose establishment is considered an important historical event, it calls for optimism towards strengthening the guarantees necessary to ensure respect for human rights and fundamental freedoms. However, one who contemplates the reality of this court sees that many difficulties and obstacles block its path that would limit its effectiveness and the realization of the supreme goal for which it was established. It embodies the international criminal protection of human rights and fundamental freedoms. تناولت هذه الدراسة موضوع حماية حقوق الإنسان في ظل قواعد القانون الدولي الجنائي هذا القانون الذي يعد حديثا نسبيا على المستوى الدولي، إذ لم تتحدد معالمه وتتوضح أركانه وخصائصه إلا بعد الحرب العالمية الثانية، فلقد كان لمحاكمات نورنبرغ كبير الأثر في إنشاء وتكريس العديد من القواعد الدولية الجنائية لمحاكمة مرتكبي الانتهاكات الجسيمة لحقوق الإنسان وحرياته الأساسية، حيث كانت المنطلق للقانونيين والسياسيين للمناداة بوضع قواعد قانونية ذات طابع دولي لحماية حقوق الإنسان، فشرعت الأمم المتحدة عبر مؤسساتها بتقنين المبادئ المنبثقة عن محكمة نورنبرغ لتكون اللبنة الأولى في تأسيس القانون الدولي الجنائي، الذي يمثل الالية المثلى لتحقيق الحماية الدولية الجنائية بشقيها الموضوعي والإجرائي، ثم توالت الجهود الدولية في إطار منظمة الأمم المتحدة وبخاصة لجنة القانون الدولي، وتوجت بابرام اتفاقية روما التي بموجبها أنشات المحكمة الدولية الجنائية الدائمة لتحقيق الحماية المنشودة، حيث أسندت لها السلطة في ممارسة اختصاصها على أشد الجرائم خطورة موضع اهتمام المجتمع الدولي والمتمثلة في جريمة الإبادة الجماعية، الجرائم ضد الإنسانية، جرائم الحرب وجريمة العدوان. رغم الامال التي المصاحبة لقيام هذه المحكمة والتي يعتبر إنشاؤها حدثا تاريخيا مهما يدعو للتفاؤل تجاه تعزيز الضمانات اللازمة لكفالة احترام حقوق الإنسان وحرياته الأساسية، إلا أن المتأمل في واقع هذه المحكمة يرى بأنه تعترض طريقها العديد من الصعوبات والعوائق التي من شأنها أن تحد من فاعليتها وتحقيقها للغاية الأسمى التي أنشئت من أجلها وهي تجسيد الحماية الدولية الجنائية لحقوق الإنسان وحرياته الأساسية.
