فقه السياسة الشرعية عند إبن رضوان المالقي من خلال كتابه الشهب اللامعة في السياسة النافعة

Abstract

My topic deals with the Islamic political jurisprudence according to Ibn Radwan Almalagui through his book Ashouhoub Allamia Fi Assiassa Annafia, came in four chapters and a conclusion: Introductory chapter devoted to talk about what the definition of legitimate politics and to talk about Ibn Radwan Almalagui and his bright book; therefore, the first party come to clarify the nature of Islamic politics, and the second party talk about the definition of Ibn Radwan Almalagui, and the third party to define the book of Ashouhoub Allamia Fi Assiassa Annafia. In the first chapter I'm looking for the jurisprudence of the Caliphate according to Ibn Radwan Almalagui; so, the first topic I define the Caliphate system and I clarify its law, and the second to talk about the conditions of the Caliphate and the methods of the session, thirdly to talk about duties of the caliph and his rights, as well as the causes leading to the demise of his mandate to the nation. Presented in chapter II of the main institutions of the Caliphate to Ibn Radwan Almalagui; so, the first topic talk about the Foundation Ministry, and the second institution of the judiciary, and the third institution of house money. Highlighted in the third chapter in determining the general principles of the system of Caliphate to Ibn Radwan Almalagui; so, the first topic of the principle of justice, and the second to the principle of Shura, and the third Caliph's commitment to the principle of political morality. Finely the Conclusion included on the most important findings and recommendations of the research found. يتعلق هذا البحث بفقه السياسة الشرعية عند إبن رضوان المالقي من خلال كتابه الشهب اللامعة في السياسة النافعة، و قد جاء في فصل تمهيدي و ثلاثة فصول رئيسية و خاتمة: خصصت الفصل التمهيدي للحديث عن ماهية السياسة الشرعية و التعريف بابن رضوان المالقي و كتابه الشهب اللامعة في السياسة النافعة؛ فكان المبحث الاول لتوضيح ماهية السياسة الشرعية، و الثاني للتعريف بابن رضوان المالقي، و الثالث للتعريف بكتاب الشهب اللامعة في السياسة النافعة. و جعلت الفصل الاول للبحث في فقه الخلافة عند ابن رضوان المالقي؛ فكان المبحث الاول للتعريف بالخلافة و بيان حكم اقامتها، و الثاني للكلام عن شروط الخلافة و طرق انعقادها، و الثالث في ذكر واجبات الخليفة و حقوقه و كذا الاسباب المؤدية الى زوال ولايته على الامة. و تعرضت في الفصل الثاني لاهم مؤسسات الخلافة عند ابن رضوان المالقي؛ فاختص المبحث الاول بمؤسسة الوزارة، و الثاني بمؤسسة القضاء، و الثالث بمؤسسة بيت المال. و ابرزت في الفصل الثالث المبادئ العامة لنظام الخلافة عند ابن رضوان المالقي؛ فكان المبحث الاول لمبدا العدل، و الثاني لمبدا الشورى، و الثالث لمبدا التزام الخليفة بالاخلاق السياسية الفاضلة. و ضمنت الخاتمة اهم النتائج و التوصيات التي خلص البحث اليها.
