رحمة أوشيكن2025-09-102025-09-102025-01-31مجلة الإحياء، كلية العلوم الإسلامية، جامعة باتنة1، المجلد 25، العدد 1، الرقم التسلسلي للعدد 36، جانفي 2025، ص-ص: 301-3141112-4350https://dspace.univ-batna.dz/handle/123456789/8519في هذا المقال سنسلط الضوء على تطور السلطة القضائية في عهد الخليفة الراشد عثمان بن عفان، بالإضافة إلى عرض بعض اجتهاداته الفقهية التي كان لها الدور الكبير في تطور القضاء الإسلامي، ولا يعد القضاء في عهد عثمان بن عفان رضي الله عنه مجرد امتداد للقضاء في العهد النبوي الشريف، وعهد الخلفاء الراشدين المهدين الذين تولوا الخلافة من قبله، أبي بكر الصديق وعمر بن الخطاب - رضي الله عنهم وأرضاهم- فقط، فمع أن ذي النورين حرص على تطبيق كل ما ثبت أن النبي صلى الله عليه وسلم أو أبى بكر الصديق أو عمر بن الخطاب أنهم حكموا فيه بحذافيره، إلا أن التطورات الحاصلة في المجتمع الإسلامي آنذاك اقتضت منه أن يكيف بعض الأحكام أو أن يعطل أخرى لفترة كما فعل عمر في عام الرمادة، وقد استطاع ذو النورين بفضل سعة اطلاعه وعمق استيعابه لمقاصد الأحكام القضائية الإسلامية أن يقدم اجتهادات على مستوى الحدود والتعزير والأحكام المالية والاجتماعية، وقد أثرت هذه الأحكام على المؤسسة القضائية وأدت إلى تطورها. In this article, we will shed light on the development of the judicial authority during the era of the Rightly Guided Caliph Othman bin Affan, in addition to presenting some of his jurisprudential interpretations that had a major role in the development of the Islamic judiciary. The judiciary during the era of Othman bin Affan - may God be pleased with him - is not merely an extension of the judiciary in The noble prophetic era, and the era of the Rightly Guided Caliphs who assumed the caliphate before him, Abu Bakr al-Siddiq and Omar ibn al-Khattab - may God be pleased with them and please them - only, although Dhu al-Nourain was keen to implement everything that was proven that the Prophet - may God bless him and grant him peace - or Abu Bakr al-Siddiq Or Omar bin Al-Khattab, they ruled on it exactly, but the developments taking place in Islamic society at that time required him to adapt some rulings or suspend others for a period, as Omar did in the year of Ramadan. Thanks to his breadth of knowledge and depth of understanding of the objectives of Islamic judicial rulings, Dhul-Nourain was able to present Jurisprudence at the level of punishments, discretionary punishment, and financial and social rulings.
