ملاح, حفصيصبري سيد الليثي, فاتن2023-06-262023-06-262020-06-21كلية الحقوق والعلوم السياسية2352-975Xhttps://dspace.univ-batna.dz/handle/123456789/6418مقال منشور في المجلد 07- العدد 02 (العدد التسلسلي 19) جوان 2020- مجلة الباحث للدراسات الأكاديمية- جامعة باتنة1بصدور القانون 01-19 المتعلق بتسيير النفايات المنزلية ومراقبتها وازالتها تم وضع الإطار العام لكيفية التعامل بطريقة تتلاءم وحماية البيئة، حيث نص صراحة على مبدأ المعالجة العقلانية للنفايات، كما ألزم البلدية باعتبارها المرآة العاكسة للامركزية الإدارية والقاعدة المسؤولـة على المستوى المحلي بضرورة إعلام وتحسيس المواطن بالأخطار الناجمة عن النفايات وآثارها على الصحة والبيئة والتدابير المتخذة للوقاية منها. وأهم آلية جاء بها هذا القانون هو المخطط البلدي لتسيير النفايات المنزلية والذي يجب أن يعد وفقا للمخططات الشاملة للتسيير الأنجع للنفايات المنزلية، من خلال جمعها وفرزها ونقلها ومعالجتها وردمها في مراكز تقنية خاصة لهذا الغرض، مع مراعاة الإمكانات الاقتصادية والمالية الضرورية لوضعها حيز التطبيق. With the proclamation of Law 01-19 on the management, control and removal of household waste, a general framework has been defined for the environment protection. It explicitly states the principle of the waste rational treatment and encourages the municipality, as the mirror of administrative decentralization and the main local responsible, to inform and warn the citizens about the effects of waste on health and environment as well as the measures to be taken for preventive actions. The most important mechanism of this law is related the municipal plan for the household waste management, which is prepared in accordance with the global plans of efficient management household waste. The plan is mainly based upon the collection, selection, transportation, treatment, and finally landfilling in special technical centers.
