نوعي, مـدانيبوحميدة, عبد الكريـم2024-06-252024-06-252024-01-21كلية الحقوق والعلوم السياسية2352-975xhttps://dspace.univ-batna.dz/handle/123456789/7754مقال منشور في المجلد11-العدد01(العدد التسلسلي 28) جانفي 2024-مجلة الباحث للدراسات الاكاديمية -جامعة باتنة1من أجل تنفيذ النظم المقررة لحماية الطفل من المواثيق الدولية والقانون الدولي الإنساني، والقانون الدولي لحقوق الإنسان، واتفاقيات وبروتوكولات خاصة زمن النزاعات المسلحة غير الدولية، لابد من وجود آليات حماية دولية وأهمها أجهزة الأمم المتحدة الرئيسية والفرعية ومنها مجلس الأمن من خلال أدوراه وصلاحياته الموسعة التي تكفل حماية للطفل من كل الانتهاكات التي يتعرض لها باستمرار وبعدة أشكال خاصة في النزاعات المسلحة غير الدولية، سواء كطفل مدني أو كطفل مقاتل. وعليه واستنادا لما سبق، وفي ظل مهام مجلس الأمن في حفظ السلم والأمن الدوليين وتدخلاته لأغراض إنسانية، فإنه يضمن حماية للطفل من خلال إصدار قرارات ملزمة وتنفيذها عبر آليات وتدابير وقائية وزجرية واجبة التطبيق، وإلزام أطراف النزاعات المسلحة التقيد بها بكل الوسائل الممكنة رغم كل الصعوبات الميدانية التي يواجهها. In order to implement the established system and protect child from international instruments, international humanitarian law, international human rights law, conventions, and protocols, especially regarding non-international armed conflicts, it is necessary to have international protection institutions, mainly the principal organs and subsidiary organs of the United Nations, including the Security Council, through their expanded tasks and powers, to ensure the protection of child from all kinds of violations, whether as civilians or as child combatants. Therefore, on the basis of the above, the Security Council, within the scope of its task of maintaining and intervening in international peace and security to achieve humanitarian goals, ensures the protection of child through the adoption and implementation of binding resolutions and preventive, compulsory, and compulsory measures, as well as the compliance of all parties to armed conflicts with their obligations under these resolutions by all possible means, regardless of the difficulties they encounter on the ground.otherالطفلمجلس الأمنحماية الطفلالنزاعات المسلحة غير الدوليةArticle
