بن لعلي, مجد أوراس2023-10-092023-10-092015-03-05كلية الحقوق والعلوم السياسيةhttps://dspace.univ-batna.dz/handle/123456789/7188مقال منشور في المجلد 02- العدد 01 (العدد التسلسلي 05) مارس 2015في ظل ما يشهده العالم من عولمة اقتصادية وتجارية "على وجه الخصوص" وسعي الجزائر جاهدة للمشاركة ولعب دور فعال فيها(كالبحث عن الانضمام إلى المنظمة العالمية للتجارة WTO ) يحاول هذا البحث أن يلقي الضوء على معتقد قانون التاجر Lex Mercatoria بغية جعل المهتمين والمعنيين من أكاديميين وممارسين مهنيين في ميدان التجارة الدولية على اطلاع بمعالمه وتأثيراته في عالم التجارة والأعمال الدولية مما سيقرب المفاهيم حول دوره في تنظيم أحكام التجارة الدولية الحديثة في ثوبه المعاصر تحت مسمى قانون التاجر الحديث أو المعاصر Modern Lex Mercatoria .In view of the current wave of the world’s economic and trade globalisation “in particular”, in addition to Algeria’s endeavours to participate and play an active role in this new globalised world of trade, this paper tries to shed some light on the doctrine of the Law Merchant “ Lex Mercatoria” in an attempt to make the interested and concerned academics and practitioners, in the field of international commerce, acquainted with its milestones and impacts on the world of international business and trade. As a result, it should clarify and bring closer all concepts about the role of the “Lex Mercatoria” in regulating the modern international commerce with its new fashioned name “Modern Lex Mercatoria”.otherArticle
