حواس, صباح2023-09-132023-09-132019-05-26كلية الحقوق والعلوم السياسية2352-975Xhttps://dspace.univ-batna.dz/handle/123456789/6667مقال منشور في المجلد 06- العدد 02 (العدد التسلسلي 16) ماي 2019-الانتخابات الحرة والنزيهة هي تلك الانتخابات التي تعبر عن ارادة الهيئة الناخبة حقيقتا، ولا يتأتى ذلك إلا بوجود ضمانات دستورية وقانونية كافية توفر الحماية اللازمة للعملية الانتخابية من أية تجاوزات تؤثر على مصداقيتها . تعالج هذه الورقة موضوع الرقابة الدستورية على الانتخابات عن طريق هيئة مستقلة كضمانة لانتخابات حرة ونزيهة في ضوء تجارب عربية مقارنة مع التركيز على التجربة الجزائرية من خلال القانون العضوي للانتخابات 16/10 وكذا ما تضمنه التعديل الدستوري الأخير بخصوص انشاء الهيئة العليا المستقلة لمراقبة الانتخابات. Free and fair elections are those elections that reflect the will of the electorate, and this can only be achieved with adequate constitutional and legal guarantees that provide the necessary protection for the electoral process from any abuses that affect its credibility.
