قصيـر, أمــال2023-10-042023-10-042017-06-10كلية الحقوق والعلوم السياسية2352-975Xhttps://dspace.univ-batna.dz/handle/123456789/7016مقال منشور في المجلد 04- العدد 02 (العدد التسلسلي 11) جوان 2017إن الضبط في مجال البناء والتعمير يهدف إلى الحفاظ على النظام العام داخل المدن، ويعمل على تنظيم التوسع السكاني في المجال العمراني الذي تسوده مخالفات متعددة منها ظهور البنايات الفوضوية ومساكن لا تتوفر على الشروط اللازمة وذلك دون مراعاة منهم لقواعد التهيئة والتعمير. إلا أننا في كثير من الحالات نتساءل من يتحمل مسؤولية عدم مراقبة البناء سواء قبل الشروع أو بعد الانتهاء منه، بالرجوع إلى القوانين اتضح أن رئيس المجلس الشعبي البلدي هو الذي يتحمل المسؤولية بالدرجة الأولى عن عدم مراقبة البناء، والى ما ألت اليه المدن الجزائرية. The control in the field of construction and urbanism aims to maintain public order within the cities and works to regulate the population expansion in the urban areas. Today, it is characterized by multiple irregularities, including the emergence of chaotic buildings. House building does not take into account necessary urban conditions, rules, and laws. However, in many cases we wonder who takes responsibility for not monitoring the non-conforming buildings, whether before or after the completion of the construction, and by referencing the laws.
