شطيبي ساميناصري مريم2025-10-212025-10-212025-01-06كلية لحقوق والعلوم السياسية2352-975Xhttps://dspace.univ-batna.dz/handle/123456789/8624مقال منشور في المجلد 12- العدد01 (العدد التسلسلي 30) جانفي 2025تعد الصفقات العمومية أهم طرق تنفيذ الاعتمادات المالية المدرجة ضمن الميزانية العامة للدولة والمخصصة لتلبية الحاجات العمومية، ومن هذا المنطلق نجد أن الصفقات العمومية تعد أهم مجال لتطبيق مبادئ الشفافية، حيث أن المشرع الجزائري حدد مجموعة من الضمانات لتكريس الشفافية في القانون 23-12 المحدد للقواعد العامة للصفقات العمومية، وتتمثل بشكل خاص في إعداد دفتر الشروط والإشهار تماشيا مع التعديل الدستوري لسنة 2020 من جهة والالتزامات الدولية للجزائر في مجال مكافحة الفساد ومقتضيات القانون 06-01 المتعلقة بالوقاية من الفساد ومكافحته من جهة أخرى، إلا أن هذه الجهود تواجه مجموعة من المعوقات العملية التي تظهر نتيجة التجارب السابقة المبنية على النظام التنظيمي المتعلق بالصفقات العمومية. Public procurement is the most important method of implementing the financial allocations included in the state’s general budget and allocated to meet public needs. From this standpoint, we find that public procurement is the most important field for applying the principles of transparency, as the Algerian legislator has specified a set of guarantees to devote transparency in Law 23-12, which specifies the general rules for procurement. Public, which is represented inparticular by preparing the book of conditions and advertising in line with the constitutional amendment of 2020, Algeria’s international obligations in the field of combating corruption, and the requirements of Law 06-01 related to the prevention of corruption.
