عقون, عيسىقارش, جميلة2023-05-312023-05-312022-06-15عقون عيسى، قارش جميلة، عوائق الحماية الدولية للأقليات المسلمة، مجلة الإحياء، كلية العلوم الإسلامية، جامعة باتنة1، المجلد 22، العدد 2، الرقم التسلسلي للعدد 31، جوان 2022، ص-ص: 491-5141112-4350https://dspace.univ-batna.dz/handle/123456789/5753تعتبر قضية الحماية الدولية للأقليات المسلمة قضية هامة جدا في وقتنا الحالي، خاصة وأن هذه الأقليات تتعرض في مواقع متعددة من العالم لحروب إبادة وانتهاكات جسيمة لحقوق الإنسان الأساسية، وذلك ببساطة بسبب المعتقد الديني لأفرادها. ورغم الآليات والضمانات الكثيرة، المنصوص عليها صراحة في مختلف المواثيق الدولية والمتعلقة مباشرة بحماية الأقليات الدينية أو حماية غير مباشرة من خلال تخصيص أحكام عامة خاصة بحقوق الإنسان، إلا أن هذه الحماية القانونية لا يتم تنفيذها عمليا وتبقى مجرد حبر على ورق. لذلك فإن هذه الدراسة تبحث في العوائق والصعوبات التي تحول دون حماية فعلية للأقليات المسلمة المضطهدة والتي أشارت الدراسة إلى نماذج منها. وقد خلصت الدراسة إلى جملة من النتائج والتوصيات تضمنتها خاتمة الدراسة. The concern of the international protection of the muslim minorities is considered as highly important nowadays, particularly for the reason that is, in many areas around the world, to extermination wars and massive violations towards the basic human rights, simply due to the confession of its adepts. In spite of the multiple mechanisms and guarantees, clearly listed in the various international charters, and which are directly related to protecting the religious minorities, or indirect protection through dedicating general specialized terms related to the human protection, it is still not applicable on ground, and remains on paper. Thus, this paper searches for the obstacles and difficulties that make from the protection of the oppressed muslim minority ineffective, and whose some models are mentioned in this paper.
