تأثير الشرط التعسفي في تراجع مبدأ القوة الملزمة للعقد

Abstract

تهدف الدراسة إلى توضيح تأثير الشرط التعسفي الذي يفرضه المهني على المستهلك في العقد في تراجع مبدأ القوة الملزمة للعقد، مع توضيح مبررات ومظاهر هذا التراجع. حيث في كثير من الأحيان ما يتعمد المهنيين وضع شروط تعسفية في العقود ترجح مصلحتهم على مصلحة المستهلك، مما يخل بالتوازن العقدي وهو ما يتجلى في انعدام التوازن الظاهر بين حقوق والتزامات أطراف العقد، ولمواجهة ذلك تدخل المشرع الجزائري يهدف حماية المستهلك إلا أن هذا التدخل في المقابل أثر على استقرار مبدأ القوة الملزمة للعقد. وقد توصلت الدراسة إلى ضرورة التوفيق بين الحد من إطلاق مبدأ القوة الملزمة للعقد والحفاظ عليه كأحد ركائز الأمن التعاقدي، من خلال تقييد الحماية من الشروط التعسفية بضوابط صارمة وضبط مفهوم النظام العام التعاقدي. the study aims to Clarity the impact of the arbitrary condition Imposed by the professional on the consumer in the contract on the decline of the principle of the binding force of the contract While clarifying the justifications and manifestations of this decline. professionals often deliberately impose arbitrary conditions on contracts that favor their own interests over those of the consumer thus disrupting the contractual balance. this is evident the apparent lack of balance between the rights and obligations of the parties to the contract. to counter this the Algerian legislators intervened with the aim of protecting the consumer. however, this intervention in turn, affected the stability of the principle of the binding force of the contract. the study concluded that it is necessary to reconcile the principle of binding force of the contract with its preservation, as one of the pillars of contractual security, by restricting protection from arbitrary conditions with strict controls and regulating the concept of public contractual order.
