حكم إجهاض الجنين المشوه في الفقه الإسلامي والقانون الوضعي

Abstract

بعد أن سهل -اليوم- اكتشاف التشوهات التي تصيب الجنين في بطن أمه، وكان ذلك عونا للعلماء أن يقترحوا العلاجات المتاحة لبعض تلك التشوهات في بديات الحمل الأول، ولما استعصت بعض تلك التشوهات على العلاج، اتجه المقترح إلى إجهاض تلك الأجنة المشوهة، وطُلب رأي القانون والفقه في ذلك، وقد حاول هذا البحث أن يسلط الضوء على الآراء الفقهية التي بحثت هذه المسألة، وكذا موقف التشريعات القانونية من إجهاض الجنين المشوه.It became easy nowadays to discover the deformities of the foetus in the womb of the mother, it was of the utmost help to the scientists to propose some available treatments to some of these deformities in the initial stages of the pregnancy. however, when some deformities became arduous, the proposer resorted to abort those distorted fetuses, and asked for the opinion of the law and jurisprudence in the matter. This research attempts to shed light on jurisprudence opinions which looked into this issue, as well as the stance of legal legislation from the abortion of the deformed fetus.
